Progress was seen in Nick Carter’s defamation case after a judge ruled that the proceedings can continue.
The Backstreet Boys band member was accused of allegedly assulting women, including a 17-year-old. However, Nick immediately denied the allegations and filed defamation cases against the individuals. However, an anti-SLAPP motion which stands for a “Strategic Lawsuit Against Public Participation,” was filed on the matter. The purpose of an anti-SLAPP motion is to prevent retaliatory lawsuits if an individual comes forward with information on matters of public interest.
A Nevada Supreme Court judge, though, noted that the woman “failed to satisfy her burden,” according to court documents obtained by The Mirror. Furthermore, the court wrote: Our resolution of this appeal has been hindered by [the woman’s] failure to identify with specificity any of the statements that form the basis of Ruths anti-SLAPP motion. We therefore conclude that any statements on which Carters counterclaims is based that are not specifically addressed in this order do not warrant reversal of the district courts order.
The Tuesday ruling saw a consideration of potential evidence, including witness affidavits. While the woman claimed she met Nick in an autograph line, individuals noted that there was not an autograph line after the cited event, explaining that the band left the concert venue immediately.
According to Tuesdays ruling, although she claimed she met Carter in an autograph line, several witness affidavits provided by Carter state that the Backstreet Boys member and the rest of the band left the concert venue soon after the show and there were no autograph lines after the event. The filing stated: We conclude that Carters evidence, if believed, establishes that Carter did not sexually assault [her] following the Backstreet Boys concert in 2001, such that [her] statements describing such an incident would perforce be made with knowledge of their falsity.”
The woman filed her civil complaint against Nick in Dec. 2022 with allegations of sexual battery. She claimed that she was picked out of an autograph line where Nick allegedly invited her onto the tour bus before allegedly raping her. The allegation came after Melissa Schuman, a former member of Dream, accused Nick of assaulting her in 2003 while they shot the movie The Hollow together.
Nick previously denied all the allegations against him. No criminal charges have been made against Nick Carter on this matter. The Mirror contacted legal representatives for both Nick Carter and the alleged victim.
